1. Who may use Quiz Karts
Quiz Karts is a learning game for children that is set up and supervised by a parent or guardian. Only an adult (18+) may create an account. A parent creates one or more child profiles and lets a child play under supervision.
By creating an account you confirm you are the parent or legal guardian of each child whose profile you create, and that you agree to these Terms on your household's behalf.
2. What the Service does
Quiz Karts presents reading, math, and reasoning questions inside a racing game. Children answer questions to progress; the game adapts difficulty, tracks progress, and awards in-game points and cosmetic items. Siblings on the same account can share a "park" and race head-to-head in duels.
3. Your account and security
You are responsible for keeping your password confidential and for activity under your account. Sign in is by email and password, or Google. We hash passwords and expire sign-in sessions after 30 days, but you must still protect your credentials.
4. Children's use
You are responsible for supervising your child's use. The Service is designed so that children do not log in, do not enter personal information, and cannot chat or exchange free text — the only in-game messages are a fixed set of preset emoji cheers, and play is limited to your own family.
Handling of children's information is described in the Privacy Policy and direct notice.
5. Acceptable use
You agree not to: attempt to access another family's account or data; interfere with, probe, or disrupt the Service; reverse engineer or scrape it except as permitted by law; or use it for any unlawful purpose. Access controls limit each account to its own family's data; you agree not to circumvent them.
6. Virtual items and in-game currency
The game awards points, gifts, cosmetic items, and treehouse decorations. These are part of the game only. They have no monetary value, are not your property, cannot be exchanged for cash, and cannot be transferred or sold. We may adjust, expire, or remove in-game items and balances as part of operating the game.
7. Subscriptions, billing, and refunds
Some features may require a paid subscription. Prices, billing intervals, and what each plan includes will be shown at checkout. Subscriptions renew automatically until cancelled; you can cancel at any time to stop future renewals. Payments are processed by our third-party payment processor. Refunds are governed by our Refund Policy.
[Auto-renewal disclosure language and any state-specific cancellation requirements to be completed by counsel.]
8. Intellectual property
The Service, including its software, artwork, characters, and content, is owned by [ENTITY] or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for your family's own non-commercial use. You keep no rights beyond that license.
9. Test-name references / no affiliation
Quiz Karts is independent. Any references to standardized tests or their skill areas are for descriptive purposes only. Quiz Karts is not affiliated with, authorized, or endorsed by the owners of those tests or their trademarks.
[Exact trademark attributions and nominative-use wording to be finalized by counsel once the product name is cleared per §7.4.]
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law. Quiz Karts is a practice and enrichment tool and does not guarantee any particular test score, academic result, or admissions outcome. [Full warranty-disclaimer language for counsel.]
11. Limitation of liability
[To be drafted by counsel — cap on liability, exclusion of indirect/ consequential damages, and any carve-outs, consistent with the chosen governing law.]
12. Termination
You may stop using the Service and close your account at any time (see the Privacy Policy §8 for how to request closure and deletion). We may suspend or terminate access that violates these Terms or that we must end to protect the Service or its users.
13. Changes to these Terms
We may update these Terms. If we make material changes we will provide notice by a reasonable means. [Notice mechanism to be finalized by counsel.]
14. Governing law and disputes
[Governing law, venue, and any dispute-resolution/arbitration terms to be determined by counsel and the chosen entity jurisdiction — see research/plan_business.md §7.5.]
